HR compliance in Spain: what each law requires and how to comply
The employment obligations of a company in Spain, law by law: the article in the BOE (the official state gazette), who it applies to, the penalty and what Quantummycos does for you.
By Carlos Ramos, CEO of QuantummycosUpdated: Sources: BOE
In short
From the first hire, every company in Spain must record working time (article 34.9 of the Workers’ Statute), keep a pay register (Royal Decree 902/2020), protect staff data (GDPR), prevent occupational risks (Law 31/1995) and have a protocol against sexual harassment. From 50 employees, the whistleblowing channel (Law 2/2023), the equality plan and the 2% disability quota are added; above 50, LGTBI measures. Quantummycos is the working-time record, the pay register and the whistleblowing channel; negotiating, appointing the people in charge, assessing risks and registering and deregistering staff with Social Security are still up to the company.
What Quantummycos already does for you
For these rules, whatever the law asks of a system, Quantummycos provides. What only the company can do is set out in each section.

Time recording
Time recording: Royal Decree-Law 8/2019 and article 34.9 of the Workers’ Statute
Royal Legislative Decree 2/2015, of 23 October, approving the consolidated text of the Workers’ Statute ActWith Quantummycos
Quantummycos is the daily working-time record that article 34.9 requires, on every plan: each person clocks in on the web or in the app with the server’s time, no clock-in can be deleted and every correction stays in its history.
- Who it applies to
- Every company with employees, from the first hire and in any sector. The summary with the payslip applies to part-time staff and anyone who works overtime; the consultation on how the record is organised, only where there are workers’ legal representatives.
Royal Decree-Law 8/2019 added section 9 to article 34 of the Workers’ Statute. Since 12 May 2019, every company has had to record the start and end time of each person’s working day, keep that record for four years and make it available to staff, their legal representatives and the Labour Inspectorate. For part-time contracts and to calculate overtime, the Statute also requires the hours to be totalled and a summary handed over with the payslip.
- Quantummycos does it
Record the exact start and end time of each person’s working day, every day
Art. 34.9 Workers’ StatuteWith QuantummycosAll plans
Each person clocks in, takes breaks and clocks out on the web or in the app, and the time is set by the server, never by the device. A clock-in cannot be deleted: it is corrected with a reason, and its history keeps the before and after, who changed it, when and why.
- Quantummycos does it
Keep the records for four years
Art. 34.9 Workers’ StatuteWith QuantummycosAll plans
Clock-ins and the history of their corrections have no deletion date: they are kept while the account exists, and archiving someone who leaves keeps their history in view. If the company closes its account, they are kept blocked for four years, as the data processing agreement sets out.
- Quantummycos does it
Make the record available to each employee
Art. 34.9 Workers’ StatuteWith QuantummycosAll plans
Each person can see all their clock-ins and breaks at any time on the web, and the latest ones in the app, with a mark on those the company corrected and, on the web, the history of each correction.
- Quantummycos does it
Part-time: record working time day by day and total it every month
Art. 12.4.c Workers’ StatuteWith QuantummycosAll plans
Each working day is recorded on its date, and the clock-in timeline adds up what each person worked in the month, excluding breaks. As clock-ins have no deletion date, the total for any past month can be checked again.
- Quantummycos does it
Overtime: record working time day by day and total it for each pay period
Art. 35.5 Workers’ StatuteWith QuantummycosAll plans
The hours actually worked each day are recorded. The clock-in timeline flags days that go beyond the contracted hours as overtime and adds up what each person worked in the month.
- Helps you comply
Make sure everyone on the staff records their working day, every day
Art. 34.9 Workers’ StatuteWith QuantummycosAll plans
With notifications on, the app reminds anyone whose time has passed to clock in or out. The clock-in timeline flags shifts left open, and anyone who forgot to clock in asks for a correction from the web or the app, giving a reason.
Still yours
Getting everyone to clock in every day and reviewing open shifts: Quantummycos records what is clocked, but it cannot make anyone clock in.
- Helps you comply
Make the record available to the workers’ legal representatives and the Labour Inspectorate
Art. 34.9 Workers’ StatuteWith QuantummycosProfessional and Enterprise plans
With Analytics and reporting, the record comes out as a PDF per person and month, with the DNI or NIE, breaks, overtime, how each day was recorded and an annex listing every correction, or in Excel to work with the data.
Still yours
Downloading it and handing it over when asked: the representatives and the inspectorate have no access of their own to Quantummycos.
- Helps you comply
Part-time: hand over a monthly summary of all hours, ordinary and supplementary, with the payslip
Art. 12.4.c Workers’ StatuteWith QuantummycosProfessional and Enterprise plans
The working-time record report gives, per person and month, the hours actually worked each day and the monthly total, in a PDF with a “Received” box for the person’s signature.
Still yours
Downloading it and handing it over with each payslip, and noting the supplementary hours, which Quantummycos does not separate from ordinary ones.
- Helps you comply
Overtime: hand over the summary with the payslip, pay it or give time off in lieu, and stay within 80 hours a year
Art. 35 Workers’ StatuteWith QuantummycosProfessional and Enterprise plans
The working-time record PDF is per person and month, with each day’s overtime and the monthly total, ready to hand over with the payslip.
Still yours
Handing it over with each payslip, checking which hours count as overtime under the agreed working time, and paying them or giving time off in lieu as the collective agreement or contract says (without an agreement, time off within the next four months). Also watching the cap of 80 a year and making sure overtime is voluntary unless agreed otherwise: Quantummycos does not keep the yearly count or track time off in lieu.
- Still yours
Organise and document the record through a collective or company agreement or, failing that, after consulting the workers’ legal representatives
Art. 34.9 Workers’ StatuteDeciding, and putting in writing, how working time is recorded: who clocks in, from where and how a mistake is corrected. Without a collective or company agreement, the company decides after consulting the workers’ legal representatives, if there are any.
If you do not comply
Breaching the working-time record rules is a serious infringement under article 7.5 of the Law on Infringements and Sanctions in the Social Order (LISOS): a fine of €751 to €7,500 (art. 40.1.b). For part-time staff, without the record the contract is also presumed to be full-time unless proven otherwise (art. 12.4.c of the Statute).
Whistleblowing channel
Whistleblowing channel: Law 2/2023 on whistleblower protection
Law 2/2023, of 20 February, regulating the protection of persons who report regulatory breaches and the fight against corruptionWith Quantummycos
Quantummycos is the internal channel that Law 2/2023 requires, on the Enterprise plan: anonymous by default, open to people outside the staff too, with follow-up by code, the legal deadlines in view and a register of reports that only those who manage the channel can see.
- Who it applies to
- Private companies with 50 or more employees; those subject to EU rules on financial services, anti-money laundering, transport safety or environmental protection, whatever their size; and political parties, trade unions, employers’ organisations and their foundations if they receive or manage public funds. Others may set up an internal reporting system voluntarily, and it must then meet all the requirements of the Law.
- Where it stands
- In force since 13 March 2023. The Independent Whistleblower Protection Authority, which is notified of the System Manager’s appointment and runs the external channel, has been operating since 1 September 2025 (Order PJC/908/2025).
Law 2/2023 requires companies with 50 or more employees, and some of any size, to have an internal reporting system: a secure, confidential channel for reporting breaches that accepts anonymous reports, with a System Manager, a policy and a management procedure. The company must acknowledge receipt within seven calendar days, respond within three months (six in particularly complex cases), keep a register of reports and protect whistleblowers from retaliation.
- Quantummycos does it
Have an internal channel for reporting breaches, as part of the internal reporting system
Arts. 7.1 and 10.1With QuantummycosEnterprise plan
The Whistleblowing channel is that internal channel. A report is submitted on the web or in the app, comes in with a case number and is handled on the web from receipt to response: stages, deadlines, conversation with the whistleblower and closure.
- Quantummycos does it
Open the channel to everyone the Law protects, not only staff: former employees, job applicants, self-employed workers, shareholders, contractors’ and suppliers’ staff, interns and volunteers
Arts. 3 and 5.2.aWith QuantummycosEnterprise plan
Staff use it with their own account. Anyone else uses the public entry, a page that opens without an account through a link or QR code the company creates in the channel itself: there they submit their report, anonymously or with their name, and follow it with a code.
- Quantummycos does it
Allow anonymous reports to be submitted and handled
Art. 7.3With QuantummycosEnterprise plan
Reports are anonymous by default, on the web, in the app and through the public entry. An anonymous report stores no name, user account, IP address, device data or time, only the date. It is followed and answered with a tracking code shown only once: Quantummycos keeps only a one-way fingerprint of it, so the code cannot be recovered.
- Quantummycos does it
Tell whistleblowers, clearly and accessibly, about the external channel of the Independent Whistleblower Protection Authority
Art. 7.2With QuantummycosEnterprise plan
The channel screen, on the web and in the app, and the public entry remind people that they can go to the external channel of the Independent Whistleblower Protection Authority, with a direct link.
- Quantummycos does it
Accept reports in writing or verbally, or both
Art. 7.2With QuantummycosEnterprise plan
The channel accepts them in writing from the web, the app and the public entry, which is one of the forms the Law allows. It does not take calls or voice messages.
- Quantummycos does it
Be able to keep in contact with the whistleblower and ask for more information
Art. 9.2.eWith QuantummycosEnterprise plan
Each report has a conversation with the person who submitted it, even if anonymous, who joins it with their code. Whoever manages the channel writes as “Channel team”, without their name, and their internal notes never reach the whistleblower.
- Quantummycos does it
Protect the whistleblower’s identity and the confidentiality of those concerned, with no access for unauthorised staff
Arts. 5.2.b and 33With QuantummycosEnterprise plan
Only those who manage the channel see the reports: a department manager cannot see their team’s, not even named ones. The AI assistant does not read the channel, nothing submitted or written in it goes into the activity log, and the Quantummycos team cannot open it, not even when giving support.
- Quantummycos does it
Keep a confidential register of reports received and the investigations they led to
Art. 26.1With QuantummycosEnterprise plan
Reports received is that register: every report, with its case number, category, stage and dates of receipt, acknowledgement and closure, and in each one the investigation, with its internal notes, how it was closed and the response. Only those who manage the channel can see it.
- Helps you comply
Acknowledge receipt within seven calendar days and respond within three months, extendable by three more
Art. 9.2.c and dWith QuantummycosEnterprise plan
Each report shows the days left for the acknowledgement and for the response, and the deadline is extended with one button, once and while the report is open. The list has counters for reports awaiting acknowledgement and for overdue ones, an overdue filter and a badge in the menu with those awaiting acknowledgement.
Still yours
Acknowledging, investigating and responding on time. Quantummycos sends no email or phone notification about a new report: someone has to check the channel screen.
- Helps you comply
Limit access to the system’s data to the System Manager, those who run it directly and the other people the Law lists
Art. 32.1With QuantummycosEnterprise plan
The channel is managed by roles that see the whole company and have permission on it, and by default the Administrator role has it. In User Privileges you can create a role for the System Manager and remove the channel from the others.
Still yours
Giving the channel only to those who must manage it: the System Manager, whoever runs it directly and, where appropriate, HR (if disciplinary action may follow), legal services and the data protection officer. Any role that sees the whole company and has the channel sees every report and the identity of those who gave their name.
- Helps you comply
Explain clearly and accessibly how to use the channel and the principles of the procedure and, if you have a website, do so on its home page, in a separate, easily identifiable section
Art. 25With QuantummycosEnterprise plan
The public entry provides a link and a QR code you can download to print or put on a poster, and its page explains in plain words anonymity, confidentiality, the ban on retaliation and the Authority’s external channel.
Still yours
Publishing that information, with the essential principles of your management procedure, where those who can use the channel will see it and, if you have a website, on its home page, in a separate, easily identifiable section.
- Helps you comply
Tell whistleblowers, the people concerned and staff how their data is processed in the system
Arts. 31 and 32.5With QuantummycosEnterprise plan
The channel screens tell whistleblowers that their identity is confidential and that only those who manage the channel see it, not their manager or colleagues.
Still yours
Drafting the channel’s data protection notice (who processes the data, why, for how long and how to exercise rights) and giving it to whistleblowers, the people concerned and staff, telling whistleblowers expressly that their identity will not be disclosed to the people the facts concern or to third parties. Quantummycos does not include your company’s notice.
- Still yours
Also give details of the other external channels that apply: your autonomous community’s authority and, where relevant, EU institutions
Arts. 7.2, 9.2.b and 24.2If your autonomous community has its own whistleblower protection authority, which is competent when the breach stays within its territory, also telling people about its external channel and, where relevant, those of EU institutions or bodies, for example in the management procedure and on your website: Quantummycos only links to the Independent Authority’s.
- Still yours
Hold an in-person meeting within seven days when a whistleblower asks for one, and document anything reported verbally
Art. 7.2With QuantummycosEnterprise plan
Whistleblowers can ask for the meeting in their report’s conversation, even if it is anonymous.
Still yours
Holding it within seven days and documenting it, with the whistleblower’s consent, by a recording or a complete and accurate transcript they can check, correct and sign. The same goes for any verbal report, if you also offer a phone line or voicemail.
- Still yours
Appoint the System Manager and notify their appointment and removal within ten working days
Art. 8Having the governing body appoint the System Manager (Responsable del Sistema), an individual who is normally a senior manager, or a collective body that delegates to one of its members, and notifying the appointment and any removal to the Independent Whistleblower Protection Authority, or to your autonomous community’s authority, within ten working days. In Quantummycos, the System Manager needs a role that sees the whole company and has permission on the channel.
- Still yours
Set up the system after consulting the workers’ legal representatives, and approve its policy and management procedure
Arts. 5.1, 5.2.h, 5.2.i and 9.1With QuantummycosEnterprise plan
In Document compliance, the policy is uploaded as a “Read and confirm” requirement and requested from all staff: each person reads and confirms it, the date is recorded, and new joiners receive it too.
Still yours
Consulting the workers’ legal representatives before setting it up, having the governing body approve the system policy and the management procedure, with the minimum content of article 9.2, and making the policy known within the company.
- Still yours
Refer the information to the Public Prosecutor’s Office when the facts may be a criminal offence
Art. 9.2.jWith QuantummycosEnterprise plan
When a report is resolved it can be closed as “Referred to the public prosecutor or the competent authority”, and it stays that way in the register.
Still yours
Referring it immediately to the Public Prosecutor’s Office, or to the European Public Prosecutor’s Office if it affects the EU’s financial interests: Quantummycos does not send it.
- Still yours
Delete the data of a report that was not investigated after three months, and keep none for more than ten years
Arts. 26.2 and 32.2 to 32.4Deleting, three months after receipt, the personal data of a report that has not been investigated, or keeping it only in anonymised form as evidence that the system works; as soon as they are detected, unnecessary data, special category data and the data of information shown to be false, unless the falsehood may be a criminal offence; and everything, after ten years at most. Quantummycos does not delete them on its own, and “Delete” removes the report from the app but not from the database. Permanent deletion is requested from Quantummycos in writing, including when closing the account: under the data processing agreement, the company’s data is kept blocked for four years.
- Still yours
Do not retaliate against whistleblowers
Arts. 5.2.j and 36With QuantummycosEnterprise plan
The channel has its own category, “Retaliation for having reported”, and its screens remind people that the Law prohibits any retaliation.
Still yours
Not retaliating against a whistleblower, nor threatening or attempting to do so: a dismissal, a sanction, a demotion, a poor appraisal, harassment, ostracism or any other unfavourable treatment for having reported. And protecting the whistleblower if anyone else in the company attempts it.
If you do not comply
Failing to have the internal reporting system on the Law’s terms, retaliating against a whistleblower or breaching confidentiality or anonymity are very serious infringements when intentional (art. 63.1): for a company, a fine of €600,001 to €1,000,000 (art. 65.1.b), with a possible public reprimand and a ban on subsidies or other tax benefits for up to four years and on public contracts for up to three (art. 65.2). Serious infringements carry €100,001 to €600,000, and any other breach of the Law is minor, with a fine of up to €100,000.
Pay register
Pay register: article 28 of the Workers’ Statute and Royal Decree 902/2020
Royal Decree 902/2020, of 13 October, on equal pay for women and menWith Quantummycos
Quantummycos produces the pay register from the pay on each employee profile, which AI fills in by reading the payslip: mean and median pay for women and men, the gap by job, and base salary and complements shown separately, as a PDF and in Excel.
- Who it applies to
- Every company, whatever its size, covering all its staff, managers and senior executives included. Justifying a gap of 25% or more: from 50 workers. The pay audit: companies with an equality plan.
From the first hire, a company must keep a register of the mean and median pay of women and men in each group, category or job, with base salary, each complement and each non-salary payment shown separately. With 50 or more workers, a gap of 25% or more between the sexes must be justified in the register itself. The workers’ legal representatives must be consulted before it is drawn up and have access to all of it.
- Quantummycos does it
Keep a pay register for the whole workforce, managers and senior executives included, with the average pay of women and men
Art. 28.2 Workers’ Statute and art. 5.1 RD 902/2020With QuantummycosProfessional and Enterprise plans
Quantummycos produces it from the sex and pay on each employee profile, with the pay filled in by AI from the payslip: mean and median pay for women and men across the workforce, the quartiles and, by job, the average base salary and complements and the gap in mean and median terms. It comes as a PDF and in Excel, with nobody named.
- Helps you comply
Break down, for each group, category or job, the mean and median of what was actually received in the year, by base salary, each complement and each non-salary payment
Art. 5.2 and 5.4 RD 902/2020With QuantummycosProfessional and Enterprise plans
AI reads the payslip you upload or pick from their files and fills in the year’s base salary, complements and pay in kind on the profile. Payslips are filed in each person’s folder, at hand for the breakdown.
Still yours
Enter variable pay on each profile, as AI does not fill it in, and complete what the register does not give: the median of each component by job, each complement on its own, non-salary payments such as subsistence allowances, and the figures for jobs with fewer than three women or three men, which it does not print so that nobody’s pay is revealed. And check that the figures are what was paid over the calendar year, including to people who have since left: the register uses today’s workforce and the current pay on each profile.
- Helps you comply
With 50 or more workers, justify in the register any gap of 25% or more between the sexes
Art. 28.3 Workers’ Statute and art. 6.b RD 902/2020With QuantummycosProfessional and Enterprise plans
The register gives the gap for the whole workforce (the hourly mean and median and the annual mean). With 50 or more people, it flags the gap when the hourly mean reaches 25% and warns which jobs must be justified.
Still yours
Check the gap on total pay, in mean and median terms, which is how the law measures it, and write into the register the justification that it is due to reasons unrelated to sex.
- Helps you comply
Give access to the register: in full to the workers’ legal representatives and, where there are none, the percentage differences to whoever asks
Art. 28.2 Workers’ Statute and art. 5.3 RD 902/2020With QuantummycosProfessional and Enterprise plans
The register comes as a PDF, with nobody named and the gap by job as a percentage.
Still yours
Hand it over when asked, and in full to the legal representatives: including the figures for jobs with fewer than three women or three men, which the PDF leaves out. Without legal representatives, whoever asks receives only the percentage differences, by pay component and by job, not the amounts the PDF also shows.
- Still yours
Consult the workers’ legal representatives, where there are any, at least ten days before drawing up the register and before each change
Art. 5.6 RD 902/2020Call the consultation at least ten days in advance, when drawing up the register and whenever a substantial change means it has to be updated.
- Still yours
Pay the same for work of equal value, with no discrimination on grounds of sex
Art. 28.1 Workers’ Statute and art. 4 RD 902/2020Evaluate jobs with objective criteria, for example with the official procedure in Order PCM/1047/2022, and correct any differences that are not justified. The register compares people in the same job, not different jobs of equal value.
- Still yours
If the company has an equality plan, include a pay audit in it, with a diagnosis and an action plan
Arts. 7 and 8 RD 902/2020With QuantummycosProfessional and Enterprise plans
The pay register provides starting data for the diagnosis: the gap per job, the quartiles and the share of women and men receiving complements.
Still yours
Carry out the audit: evaluate jobs, analyse the causes of the differences and set an action plan with objectives, a timetable and the people responsible. With an audit, the register must also show the means and medians for work of equal value (art. 6.a), which Quantummycos does not group.
If you do not comply
The LISOS, Spain’s law on social order infringements and penalties, has no specific offence for the pay register: the Labour Inspectorate can treat not having one as the serious infringement in art. 7.13 (€751 to €7,500). Failing to consult the workers’ legal representatives or denying them access is serious (art. 7.7). Pay discrimination is very serious (art. 8.12, €7,501 to €225,018), with loss of employment aid and rebates (art. 46 bis).
Equality plan
Equality plan: Organic Law 3/2007 and Royal Decree 901/2020
Organic Law 3/2007, of 22 March, for the effective equality of women and menWith Quantummycos
Quantummycos’s pay register gives the diagnosis the gap by sex and job, and the File repository puts the plan within reach of all staff; negotiating, registering and monitoring it is up to your company.
- Who it applies to
- Companies with 50 or more workers, counting the whole workforce across all workplaces and contracts; each part-time worker counts as one. Smaller ones, if their collective agreement requires it or the labour authority imposes it in place of ancillary penalties; for the rest it is voluntary.
With 50 or more workers, a company must negotiate an equality plan with the workforce’s representatives, after a diagnosis covering nine areas, from recruitment and promotion to pay and harassment. The plan is entered in a public register, lasts four years at most and must be monitored with regular evaluations.
- Helps you comply
Give the negotiating committee the data for the diagnosis, including the pay register data
Art. 46.2 LO 3/2007With QuantummycosProfessional and Enterprise plans
The pay register comes as a PDF and in Excel, ready for the committee: the gap by sex and job, the quartiles and the share of women and men receiving complements.
Still yours
Gather the data for the other areas (recruitment and hiring, job classification, training, promotion, working conditions, work-life balance, under-representation of women and harassment) and hand it all to the committee.
- Helps you comply
Give the workers’ legal representatives, or the staff where there are none, access to the content of the plan and to progress on its objectives
Art. 47 LO 3/2007With QuantummycosProfessional and Enterprise plans
The plan is uploaded to the company’s File repository, which all staff can open, and announced in Company news. On Enterprise you can also ask each person to read and confirm it, and the date is recorded.
Still yours
Give that information to the workers’ legal representatives and keep it up to date with the monitoring results.
- Still yours
Negotiate, approve and apply an equality plan, based on a negotiated prior diagnosis
Arts. 45.2 and 46 LO 3/2007; arts. 4, 5 and 7 RD 901/2020Set up the negotiating committee within three months of reaching 50 people, negotiate the diagnosis and the measures, and have the plan approved and submitted for registration no later than one year after those three months end. Without legal representatives, the workers’ side is made up of the most representative unions and those of the sector.
- Still yours
Register the equality plan in the public register, with its statistical sheet
Art. 46.5 LO 3/2007 and art. 11 RD 901/2020Apply for registration in the register of collective agreements (REGCON) or in your region’s own register, whether the plan is mandatory or voluntary.
- Still yours
Set the plan’s term, four years at most, and monitor it with at least one interim and one final evaluation
Art. 9 RD 901/2020Set up the monitoring committee, carry out the evaluations and review the plan when monitoring calls for it or when the workforce, the organisation or the pay system changes substantially. And negotiate a new one when it expires.
If you do not comply
Failing to meet the obligations on equality plans and measures is a serious infringement (art. 7.13 LISOS, €751 to €7,500). If the plan was imposed in place of ancillary penalties, not drawing it up or not applying it is very serious (art. 8.17, €7,501 to €225,018). Denying the workers’ legal representatives information on the plan is serious (art. 7.7).
Data protection
Staff data protection: GDPR
Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation)With Quantummycos
Quantummycos acts as processor of staff data, under the data processing agreement accepted at sign-up, and protects it with encrypted connections, sessions that expire and roles that limit who sees what.
- Who it applies to
- Every company that processes its staff’s data, from the first hire and in any sector. The record of processing activities also applies to companies with fewer than 250 people, because staff data is processed continuously, not occasionally.
The General Data Protection Regulation sets out how a company processes its staff’s data: on what legal basis, which data, for how long, how securely and what each person must be told. The company is the controller, and a provider that processes the data on its behalf is its processor, under a written contract. Each person can access their data, have it corrected and ask for it to be erased.
- Quantummycos does it
Have a written data processing agreement with any provider that processes staff data
Art. 28(3) and 28(9) GDPRWith QuantummycosAll plans
The data processing agreement is part of the Terms and conditions: it is accepted when the company signs up, with the same tick box, and the date is stored. Customers who contract another way accept it when placing their order. It covers what art. 28(3) requires, including that Quantummycos processes the data only to provide the service and on the company’s instructions.
- Quantummycos does it
Apply security measures appropriate to the risk in the system that processes the data
Art. 32(1) GDPRWith QuantummycosAll plans
Connections are encrypted, and passwords are stored with a key derivation function, never in plain text; a new one needs at least ten characters, with letters and numbers. Sessions expire on their own, and resetting a password closes every open session. Files go to private storage, and each download uses a link that expires after five minutes.
- Quantummycos does it
Make sure each person can only access the data the company authorises
Art. 32(4) GDPRWith QuantummycosAll plans
Each role has a scope (the whole company, its departments or only the person’s own data) and permissions for each module, and Quantummycos enforces them on every screen, in files and in the AI assistant’s answers. Pay is visible only to the person concerned and to company-wide roles.
- Helps you comply
Tell each person how their data will be processed when it is collected
Art. 13(1) and 13(2) GDPRWith QuantummycosProfessional and Enterprise plans
With the File repository, each person’s signed notice can be kept in their files. On Enterprise, Document compliance also comes with the “Data protection and confidentiality policy” to read and confirm: it is requested from all staff, including new joiners, and records who has confirmed it and when.
Still yours
Writing the notice, with the purposes, legal basis, retention periods and recipients, and giving it to each person when their data is collected. The catalogue policy comes with a name and description only; the company provides the text.
- Helps you comply
Process only the data that is needed, including in default settings
Arts. 5(1)(c) and 25 GDPRWith QuantummycosAll plans
In Quantummycos, location is read only at the moment of clocking in, never in the background; clocking in uses no fingerprint, face or camera; and the activity log records who changed what and when, but not what they wrote.
Still yours
Deciding which staff data is really needed and entering nothing more. Clock-in location is on by default on Professional and Enterprise, so if it is not needed it should be switched off in Settings. And adjusting each role’s permissions.
- Helps you comply
Give each person only the access they need, including among colleagues
Art. 32(1) and 32(4) GDPRWith QuantummycosAll plans
The three default roles come with every plan, and Enterprise adds custom roles. Two-step verification, with a code sent by email, is switched on in Settings, and on Professional the activity log records who made each change and when.
Still yours
Giving each person the role they need, reviewing who has company-wide scope and switching on two-step verification, which is off by default. And looking after the credentials and devices used to sign in.
- Helps you comply
Notify the Spanish Data Protection Agency (AEPD) of data breaches within 72 hours, unless they are unlikely to pose a risk, and document them all
Art. 33(1), 33(2) and 33(5) GDPRWith QuantummycosAll plans
The data processing agreement requires Quantummycos to tell the company without undue delay about any breach of its data that it becomes aware of, with the information the company needs to meet its own obligations.
Still yours
Assessing the risk, notifying the AEPD within 72 hours where required and documenting every breach, whether or not it is notified.
- Helps you comply
Process no health data beyond what the employment relationship requires
Art. 9(1) and 9(2)(b) GDPRWith QuantummycosAll plans
Sick leave, a workplace accident or a medical appointment is recorded by its type, without asking for a diagnosis. Phone notifications only show the dates, never the type of absence, because they can be seen on the lock screen.
Still yours
Not asking for or attaching medical reports or anything that reveals a diagnosis, including in a request’s notes, and using roles to limit who sees absences: the type of each one is visible to anyone who can see that person’s absences.
- Helps you comply
Respond to each person’s rights of access, rectification, erasure and portability
Arts. 15 to 20 GDPRWith QuantummycosAll plans
Each person can see their data in My Profile and correct their personal details (name, surnames, date of birth, phone, DNI or NIE and social security number), and check their clock-ins and absences on the web and in the app. On Professional, a person’s working-time record can also be exported as a PDF or Excel file from Analytics and reporting.
Still yours
Answering each request within one month (art. 12(3)), extendable by two more if it is complex. The app has no download of a person’s own data and no permanent erasure: erasure is requested from Quantummycos in writing, and Quantummycos helps the company respond.
- Still yours
Only use a processor that offers sufficient guarantees to protect the data
Art. 28(1) GDPRWith QuantummycosAll plans
The Privacy policy sets out the security measures and the providers that process data to deliver the service, where they do so and, if data leaves the European Union, under which safeguard. Before adding or replacing one, Quantummycos gives at least fifteen days’ notice by email, and the company can object.
Still yours
Reading the data processing agreement and the list of providers before starting, including those that process data outside the European Union, and keeping them with the company’s data protection records. If the account was opened before sign-up asked for the agreement to be accepted, asking Quantummycos for a signed copy.
- Still yours
Keep data only for as long as necessary
Art. 5(1)(e) GDPRWith QuantummycosAll plans
When the contract ends, Quantummycos keeps the company’s data blocked for four years, the retention period for the working-time record, and then erases it, unless the company asks earlier for it to be returned or erased.
Still yours
Setting how long each piece of data is kept and asking Quantummycos in writing to erase it when that period ends. While the account is active, Quantummycos does not delete, of its own accord, clock-ins, absences, documents or any other staff data the company keeps, and “Delete” removes data from the app but does not erase it.
- Still yours
Keep a record of processing activities, including working-time recording
Art. 30(1) and 30(5) GDPRWith QuantummycosAll plans
The data processing agreement describes the processing Quantummycos carries out (purpose, people, types of data and special categories), and the Privacy policy sets out the providers, transfers and security measures. Both can be used to describe in the record what is processed with this tool.
Still yours
Keeping the record in writing, with each staff processing activity: payroll, working-time recording and, if used, clock-in location. Quantummycos does not generate it.
- Still yours
Make sure decisions about people are made by a person, not a tool
Art. 22(1) GDPRNot deciding anything about anyone (a disciplinary measure, a dismissal, a promotion) based only on what a tool says, including a list of late arrivals or absences, and always reviewing each case.
If you do not comply
Depending on the obligation breached, fines of up to €10 million or 2% of total worldwide annual turnover for the previous year (art. 83(4)), or up to €20 million or 4% (art. 83(5)), whichever is higher. The highest apply to the principles, health data and each person’s rights. The LOPDGDD classifies infringements as very serious, serious or minor (arts. 72 to 74).
Digital rights
Right to disconnect, devices, cameras and geolocation: LOPDGDD
Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the Guarantee of Digital RightsWith Quantummycos
With clock-in geolocation, Quantummycos stores a single point, the clock-in, never during the day or in the background, and it does not monitor anyone with cameras or microphones or access the content of staff devices.
- Who it applies to
- Every company with employees, from the first hire. The articles on devices, cameras and geolocation apply to companies that give staff digital devices, have cameras at work or record staff location.
Organic Law 3/2018 adapts the GDPR in Spain and recognises digital rights at work: privacy when using company devices, the right to disconnect outside working hours, limits on cameras and sound recording, and prior information about geolocation. It also requires data that is rectified or erased to be blocked while liability can still be claimed, and destroyed afterwards.
- Helps you comply
Tell staff and their representatives beforehand, expressly, clearly and unambiguously, about geolocation and their rights
Art. 90 LOPDGDDWith QuantummycosProfessional and Enterprise plans
Clock-in geolocation stores a single point, at the moment of clocking in, with its accuracy: never when clocking out, during breaks or in the background. The company switches it off or makes it mandatory in Settings, and the notice can be kept signed in each person’s files or, on Enterprise, sent out to be read and confirmed.
Still yours
Writing the notice (what is collected, why, how long it is kept and how to exercise the rights of access, rectification, restriction and erasure) and giving it to staff and, if there are any, their representatives before anyone clocks in with location. Location is on by default on Professional and Enterprise, and the phone or browser permission prompt does not replace this information.
- Still yours
Guarantee the right to disconnect and draw up an internal policy after hearing the workers’ legal representatives
Art. 88 LOPDGDDWith QuantummycosAll plans
Phone reminders to clock in or out only reach people who switch notifications on, at their start or finish time plus the company’s margin: the clock-in reminder is not sent on a day of absence, and the clock-out reminder only if the working day is still open. Email notifications about activity, such as clock-ins, absences or shifts, stay off until the company switches each one on and chooses who receives it. The policy can be published in Company news (Professional) or sent out to be read and confirmed (Enterprise).
Still yours
Drawing up the right-to-disconnect policy after hearing the legal representatives, for all staff including management, with training and awareness on reasonable use of technology. And respecting it: Quantummycos has no quiet hours, so a notification someone triggers outside working hours, for example by approving an absence, arrives straight away.
- Still yours
Set criteria for using company digital devices, with the participation of the workers’ legal representatives, and inform staff of them
Art. 87 LOPDGDDWith QuantummycosEnterprise plan
On Enterprise, the criteria can be sent to all staff to read and confirm with Document compliance, which records who has confirmed them and when.
Still yours
Drafting the criteria for using company computers, phones and email with the participation of the legal representatives, and informing staff of them. If private use is allowed, specifying the authorised uses and privacy safeguards before any access to their content.
- Still yours
Give notice before using cameras or recording sound at work, and never do so in rest areas
Arts. 89 and 22 LOPDGDDIf there are cameras, informing staff and their representatives beforehand, expressly, clearly and concisely, and putting up the information sign in a visible place. Never in changing rooms, toilets, canteens or rest areas. Images are erased within one month, except those that evidence an act against people, property or facilities, which are made available to the authorities within 72 hours, and sound may only be recorded where there are significant security risks.
- Still yours
Block data when it is rectified or erased, and destroy it once liability is time-barred
Art. 32 LOPDGDDWith QuantummycosAll plans
What is deleted in the app is no longer shown there, although it is not destroyed. When the contract ends, Quantummycos keeps the company’s data blocked for four years, accessible only to respond to the company itself, the competent authorities or the courts, and then erases it.
Still yours
Keeping anything corrected or deleted blocked while liability can still be claimed, with a secure copy where the app does not keep it, and asking Quantummycos in writing to destroy it once that liability is time-barred: the app does not destroy deleted data on its own.
If you do not comply
Acts by the company that breach staff privacy and dignity are a very serious infringement under article 8.11 of the Law on Infringements and Sanctions in the Social Order (LISOS): a fine of €7,501 to €225,018 (art. 40.1.c). Disregarding the information, hearing and consultation rights of the workers’ legal representatives is serious (art. 7.7): €751 to €7,500. And failing to give staff the information the GDPR requires about how their data is processed is very serious under the LOPDGDD (art. 72.1.h), with fines of up to €20 million or 4% of total worldwide annual turnover, whichever is higher (art. 83(5) GDPR).
Health and safety
Occupational risk prevention: Law 31/1995
Law 31/1995, of 8 November, on the Prevention of Occupational RisksWith Quantummycos
On the Enterprise plan, Quantummycos records who has read the prevention plan, who marked each new starter’s induction training as done and when each medical check-up expires.
- Who it applies to
- Every company with employees, whatever its headcount.
- Where it stands
- In force. On 28 April 2026 the Council of Ministers approved, at first reading, a preliminary draft bill that reforms it and gives more weight to psychosocial risks: it is still going through the process and is not yet binding.
It requires every company to organise prevention, assess the risks of each job, inform, consult and train its staff, monitor their health and keep the documentation. Size only changes how prevention is organised: with up to ten people, or up to twenty-five with a single workplace, the employer can take it on personally if they meet the requirements of the Prevention Services Regulation, although health surveillance must always be covered another way.
- Helps you comply
Also prevent the risks arising from how work is organised (psychosocial risks), including workplace harassment, within the assessment and planning
Arts. 14.2 and 16 LPRLWith QuantummycosEnterprise plan
The Whistleblowing channel has a “Workplace harassment” type: anyone on the staff can report it, anonymously by default, and whoever manages the channel can talk to them and keep internal notes. The Document compliance catalogue also includes an “Equality and harassment policy” type so that each employee reads and confirms your company’s protocol.
Still yours
Assess psychosocial risks as part of the risk assessment and write the protocol that sets out how a harassment case is investigated and acted on: the channel is the way to report it, not the procedure.
- Helps you comply
Inform each employee of the risks of their job and of the protection, prevention and emergency measures
Art. 18.1 LPRLWith QuantummycosEnterprise plan
The Document compliance catalogue includes the “Health and safety plan” to read and confirm: each employee reads and confirms it, the date is recorded and it is requested again after 12 months. You can create types by department with the risks of each job.
Still yours
Write up the information on the risks of each job and upload it: the type that comes as standard is the same document for the whole staff. Where there are representatives, general information goes through them, but the risks of each job are explained to each employee directly.
- Helps you comply
Consult staff and let them take part in all health and safety matters
Arts. 18.2 and 33 LPRLWith QuantummycosProfessional and Enterprise plans
With Staff surveys you can ask the whole staff about a measure or a proposal, in a named or an anonymous survey, and see the answers and how many people took part.
Still yours
Consult in good time before deciding and take the proposals into account. Where there are representatives, consultation is with them: the prevention delegates and, in companies or workplaces with 50 or more employees, the health and safety committee.
- Helps you comply
Train each employee in prevention for their job when they are hired and whenever their duties, equipment or technology change
Art. 19 LPRLWith QuantummycosEnterprise plan
The “New starter” process in Onboarding and offboarding includes the task “Health and safety induction for the role”, recording who marked it done and when. And you can create a document type with an expiry date to request the training certificate.
Still yours
Deliver the training, both theory and practice, during working hours or deducting that time from them, at no cost to the employee, and repeat it when needed.
- Helps you comply
Guarantee regular health surveillance, voluntary except in specific cases and confidential: the company only receives the conclusions on fitness for work
Art. 22 LPRLWith QuantummycosEnterprise plan
The “Occupational health check” type in the catalogue asks for the fitness certificate and expires 12 months after approval, so you can see whose next check-up is due.
Still yours
Offer it and set how often it happens according to the risks of the job. It is voluntary except in specific cases and the type comes marked as mandatory: mark it optional if it is not compulsory for everyone in your company. Upload only the fitness certificate, never the medical report, and check who can see it: department managers see their team’s documents.
- Helps you comply
Draw up and keep available to the labour authority the plan, the assessment, the planning, the health checks and the list of accidents, and report harm to health
Art. 23 LPRLWith QuantummycosProfessional and Enterprise plans
In the File repository you keep the plan, the assessment and the planning, with a record of who uploaded each file and when. Absences of the “Work accident” type are kept with their dates, and the Leave and absence report can be narrowed down to that type.
Still yours
Draw up those documents, keep the list of work accidents and occupational diseases that caused more than one day off work, and report harm to health to the labour authority through the official channel: the app does not send anything. Health check records do not belong in the company area of the File repository, which the whole staff can see.
- Still yours
Organise prevention through one of the arrangements the law allows: the employer takes it on, designates employees, sets up an in-house prevention service or hires an external one
Art. 30 LPRL and arts. 10 and 11 RD 39/1997Choose the arrangement and set it out in the prevention plan. You can only take it on yourself with up to 10 employees, or up to 25 with a single workplace, if you usually work there, have the necessary training and the activity is not one of the hazardous ones in Annex I of RD 39/1997. Even then, health surveillance has to be covered by another arrangement.
- Still yours
Have a prevention plan, assess the risks of each job and plan the preventive activity, updating the assessment when working conditions change
Art. 16.1 and 16.2 LPRLDraw up the prevention plan, carry out the initial assessment of each job and plan the measures with their deadline, the people responsible and the resources. Review the assessment when working conditions change or after any harm to health.
- Still yours
Coordinate prevention with the other employers and self-employed people working at the same workplace
Art. 24 LPRLCooperate with those employers, share information on risks and measures, including emergency ones, and agree how to coordinate. If you are the owner of the workplace, also give them the information and instructions on its risks and emergency measures.
If you do not comply
Each of these is a serious infringement, fined from €2,451 to €49,180 (art. 40.2.b LISOS): having no prevention plan or risk assessment (art. 12.1), failing to organise prevention (art. 12.15.a), to inform, train or consult staff (arts. 12.8 and 12.11), to carry out the required medical check-ups (art. 12.2), to report serious, very serious or fatal accidents to the labour authority (art. 12.3) or to coordinate with the other employers at the workplace (art. 12.13). Breaching the confidentiality of health surveillance data is very serious (art. 13.5): from €49,181 to €983,736 (art. 40.2.c).
Sexual harassment
Sexual and gender-based harassment protocol: Organic Law 10/2022
Organic Law 10/2022, of 6 September, on the comprehensive guarantee of sexual freedomWith Quantummycos
On the Enterprise plan, Quantummycos provides a route for complaints of sexual and gender-based harassment, with their own category in the Whistleblowing channel, anonymous if preferred, and lets you ask all staff to read and confirm the protocol; drafting it, negotiating it and deciding each case is up to your company.
- Who it applies to
- Every company, whatever the size of its workforce.
Organic Law 10/2022 requires every company to promote working conditions that prevent sexual harassment and gender-based harassment, including online, and to set up specific procedures to prevent them and to channel complaints from those who suffer them. Companies must also promote awareness and offer training to all staff, and include sexual violence in the risk assessment of posts held by women.
- Quantummycos does it
Provide a route for complaints from anyone who suffers sexual or gender-based harassment, including online
Art. 12.1 Organic Law 10/2022 and art. 2.1 Royal Decree 901/2020With QuantummycosEnterprise plan
The Whistleblowing channel has its own category, “Sexual or gender-based harassment”. The complaint is submitted on the web or in the app, anonymously if preferred, followed with the code or under “Your reports”, with a conversation with whoever manages it, and only those who manage the channel can see it.
- Helps you comply
Promote awareness and offer training to all staff for comprehensive protection against sexual violence
Art. 12.2 Organic Law 10/2022With QuantummycosEnterprise plan
The catalogue that Document compliance starts with includes the “Equality and harassment policy” as a read-and-confirm requirement every 24 months. It is requested from all staff, including new joiners, and its record shows who has confirmed it, when, and who has not.
Still yours
Adding the protocol’s text, as a PDF or written into the requirement itself, before staff start confirming it, because the catalogue includes the requirement without the text, and training all staff: reading and confirming the protocol is no substitute for training.
- Still yours
Set up a specific procedure to prevent sexual and gender-based harassment and to handle complaints
Art. 12.1 Organic Law 10/2022 and art. 2.1 Royal Decree 901/2020Approving the protocol, negotiating it with the workers’ legal representatives if there are any: who receives and investigates complaints, within what deadlines, what interim measures are taken and with what safeguards. And deciding each case: the channel is the route, not the protocol.
- Still yours
Include sexual violence in the risk assessment of posts held by women, and train and inform them about it
Art. 12.2 Organic Law 10/2022Including it among the occupational risks of every post held by women in the risk assessment, and training and informing them about that risk.
If you do not comply
Sexual harassment within the scope of the company’s management powers, whoever commits it, is a very serious infringement (art. 8.13 of the Law on Infringements and Sanctions in the Social Order, LISOS), as is gender-based harassment that the company knows of and does not take the necessary steps to stop (art. 8.13 bis): a fine of €7,501 to €225,018 (art. 40.1.c), with loss of employment aid and rebates and possible exclusion from them for six months to two years (art. 46 bis).
LGTBI measures
LGTBI measures and protocol: Law 4/2023 and Royal Decree 1026/2024
Law 4/2023, of 28 February, for the real and effective equality of trans people and for the guarantee of the rights of LGTBI peopleWith Quantummycos
On the Enterprise plan, Quantummycos gives complaints of harassment and discrimination a confidential route, the Whistleblowing channel, open to job applicants and suppliers too, and lets you ask all staff to read and confirm the measures and the protocol; negotiating them is up to your company.
- Who it applies to
- Companies with more than 50 employees, that is, from 51, counting the whole workforce: each part-time contract counts as one person, and fixed-term contracts that ended in the previous six months add one for every hundred days worked or part thereof. With 50 or fewer it is voluntary. The protocol also protects job applicants, agency workers, suppliers, customers and visitors.
Law 4/2023 requires companies with more than 50 employees to have a planned set of measures for the real and effective equality of LGTBI people, including a protocol against harassment and violence towards them, agreed through collective bargaining. Royal Decree 1026/2024 sets the deadlines for negotiating it, the minimum measures and what the protocol must contain, from the complaints procedure to the ban on retaliation.
- Helps you comply
Include in the protocol a complaints procedure with confidentiality, protection for the victim and a ban on retaliation
Art. 8.4 and Annex II Royal Decree 1026/2024With QuantummycosEnterprise plan
Harassment or discrimination is reported in the Whistleblowing channel, anonymously if preferred, and people outside the staff, such as a job applicant or a supplier, can use the public entry. Only those who manage the channel can see the complaints, and each one is recorded with its stages and the conversation with the person who made it.
Still yours
Agreeing in the protocol who on the committee receives complaints, the deadline for resolving them, interim measures, the report and the resolution. The channel has no category of its own for anti-LGTBI harassment: it is reported under “Workplace harassment” or “Discrimination”.
- Helps you comply
Train all staff on the workplace rights of LGTBI people and make the measures and the protocol known
Annex I, section four, Royal Decree 1026/2024With QuantummycosEnterprise plan
In Document compliance, the measures and the protocol are uploaded as a “Read and confirm” requirement and requested from all staff: each person reads and confirms them, the date is recorded, and new joiners receive them too.
Still yours
Including modules on the workplace rights of LGTBI people in the training plan, for all staff, including middle managers, senior managers and those who run HR: reading and confirming is no substitute for training.

Negotiate a planned set of measures for LGTBI equality, including a protocol against harassment and violence towards LGTBI people
Art. 15.1 Law 4/2023; arts. 4, 5 and 8 Royal Decree 1026/2024Setting up the negotiating committee within the deadlines of Royal Decree 1026/2024 (as a rule, three months from when the workforce exceeds 50) and agreeing the measures, at least those in Annex I, and the protocol, or extending the general harassment protocol to LGTBI people. If there is no agreement three months after negotiations begin, or the collective agreement does not include them, the measures in the Royal Decree apply until others are agreed.
If you do not comply
Harassment on grounds of sexual orientation or identity, gender expression or sex characteristics is a very serious infringement if the company knows of it and does not take the necessary steps to stop it (art. 8.13 bis of the Law on Infringements and Sanctions in the Social Order, LISOS), as are decisions that discriminate on those grounds (art. 8.12): a fine of €7,501 to €225,018 (art. 40.1.c), with loss of employment aid and rebates and possible exclusion from them for six months to two years (art. 46 bis).
Hours and rest
Maximum working hours and rest: articles 34 and 37 of the Workers’ Statute
Royal Legislative Decree 2/2015, of 23 October, approving the consolidated text of the Workers’ Statute ActWith Quantummycos
On every plan, the clock-in timeline flags each rest of less than twelve hours between working days and each day of more than six hours without a 15-minute break, citing the article of the Statute that requires it.
- Who it applies to
- Every company, from the first hire. A collective or company agreement can distribute working time differently as long as rest periods are respected, Royal Decree 1561/1995 adapts them in some sectors, and the limits are stricter for under-18s.
Article 34 of the Statute caps working time at 40 hours a week averaged over the year and, unless agreed otherwise, at nine ordinary hours a day, with twelve hours’ rest between working days and a break of at least 15 minutes in continuous working days of more than six hours. Article 37 adds a weekly rest of a day and a half in a row. These are limits the company respects when it organises schedules and shifts.
- Helps you comply
Leave at least twelve hours between the end of one working day and the start of the next
Art. 34.3 Workers’ StatuteWith QuantummycosAll plans
The clock-in timeline flags every rest of less than twelve hours between two working days, showing the hours there were and the text of the article.
Still yours
Organising schedules and shifts to respect it and correcting whatever is flagged: the warning does not stop anyone clocking in and the rota does not check it when planning.
- Helps you comply
Work no more than nine ordinary hours a day, unless agreed otherwise, or eight for under-18s
Art. 34.3 Workers’ StatuteWith QuantummycosAll plans
The record gives the hours actually worked each day, excluding breaks, and the clock-in timeline flags anything beyond each person’s contracted hours as overtime.
Still yours
Watching the nine-hour ordinary maximum, or the one set by your collective agreement, and the eight-hour limit for under-18s: Quantummycos does not check them.
- Helps you comply
Give a break of at least 15 minutes when a continuous working day exceeds six hours
Art. 34.4 Workers’ StatuteWith QuantummycosAll plans
Breaks are clocked, and the clock-in timeline flags days of more than six hours without 15 minutes’ rest, showing the minutes there were and the text of the article.
Still yours
Organising the break, applying what the collective agreement or contract says about whether it counts as working time, and watching the 30-minute break for under-18s, due when their continuous working day exceeds four and a half hours, which Quantummycos does not check.
- Helps you comply
Keep to the maximum of 40 hours a week averaged over the year, and give at least five days’ notice of the schedule resulting from any irregular distribution
Arts. 34.1 and 34.2 Workers’ StatuteWith QuantummycosProfessional and Enterprise plans
The rota adds up each person’s planned hours by week, month and year, and each person sees their shifts in the app. The working-time record gives the hours actually worked.
Still yours
Working out the annual average, agreeing any irregular distribution (without an agreement, at most 10% of annual working time, with the differences made up within twelve months) and telling each person the resulting day and time at least five days in advance: Quantummycos does not calculate the average or check the notice period.
- Helps you comply
Give a minimum weekly rest of a day and a half without interruption (two days for under-18s)
Art. 37.1 Workers’ StatuteWith QuantummycosProfessional and Enterprise plans
The rota shows, person by person, which days they work each week, at what times, and which days they have off.
Still yours
Planning the weekly rest, which can be accumulated over periods of up to fourteen days, and checking it is respected, with the exceptions Royal Decree 1561/1995 allows in your sector: neither the rota nor the record checks it.
If you do not comply
Breaching the limits on working time, overtime or rest is a serious infringement under article 7.5 of the Law on Infringements and Sanctions in the Social Order (LISOS): a fine of €751 to €7,500 (art. 40.1.b).
Leave and time off
Annual leave, time off and sick leave: articles 23, 34.8, 37, 38 and 48 of the Workers’ Statute
Royal Legislative Decree 2/2015, of 23 October, approving the consolidated text of the Workers’ Statute ActWith Quantummycos
On every plan, each person requests their annual leave and time off on the web or in the app, with absence types that follow the Workers’ Statute; only approved annual leave uses up their days for the year, and a record is kept of who decided each request and when.
- Who it applies to
- Every company, from the first hire. Collective agreements can improve on the days of annual leave and paid leave. The twenty hours of training apply to staff with at least one year’s service.
- Where it stands
- In force. Since 23 October 2026, article 37.6 has new wording (Law 4/2026 and Royal Decree-Law 31/2026, the latter awaiting validation by the Congress of Deputies): reduced hours to care for a son or daughter with cancer or another serious illness are also granted for continuous treatment without a hospital stay, both parents can take them at the same time and, in exceptional cases, they continue after the son or daughter turns 26.
The Workers’ Statute guarantees at least thirty calendar days of paid annual leave a year, which cannot be swapped for money and whose dates are agreed and known two months in advance (art. 38). It also sets paid leave for marriage, serious illness or hospitalisation of a relative, bereavement or moving house, among others (art. 37), the suspension for birth and parental leave (arts. 48 and 48 bis), adapted working hours to balance work and family life and reduced hours for caring (arts. 34.8 and 37.6) and twenty hours of training a year (art. 23.3). Sick leave is notified to the company by the INSS, the national social security institute, and the company sends its own data back through the RED system (Royal Decree 625/2014).
- Helps you comply
Give at least thirty calendar days of paid annual leave a year, without swapping them for money, agree the dates and let each person know them two months in advance
Art. 38 Workers’ StatuteWith QuantummycosAll plans
Each person has their annual leave days for each year, either the company’s figure or their own, and requests leave on the web or in the app. Only approved leave uses up that allowance. In the year someone joins, the pro rata share is suggested, and a company administrator can charge a period of leave to a different year, for example when sick leave prevented it from being taken in time.
Still yours
Setting each person’s days (thirty calendar days at least, or whatever your collective agreement says), agreeing the dates, giving two months’ notice of them and letting people take later any leave that overlaps with sick leave or with the suspension for birth: Quantummycos does not check the minimum, the notice or those deadlines.
- Helps you comply
Grant paid leave, with prior notice and proof: marriage or civil partnership, accident, serious illness or hospitalisation of a relative, bereavement, moving house, public duty and representative duties, among others
Art. 37.3 Workers’ StatuteWith QuantummycosAll plans
Marriage or civil partnership, serious illness or hospitalisation of a relative, bereavement, moving house, public duty and union or works council duties each have their own absence type, which does not use up annual leave. They are requested with their dates on the web or in the app and approved or rejected, with a record of who decided and when, and the proof is attached on the web.
Still yours
Checking that the days match the law or your collective agreement (fifteen calendar days for marriage, five for serious illness or hospitalisation of a relative, two for a bereavement plus two more if travel is needed, one for moving house) and asking for the proof: Quantummycos does not control how long each type of leave lasts, and absences are full or half days, not hours.
- Helps you comply
Pay for absences due to urgent family emergencies (force majeure) up to the equivalent of four days a year
Art. 37.9 Workers’ StatuteWith QuantummycosAll plans
It has its own absence type, “Family emergency”, which is requested on the web or in the app, approved with a record of who did it and when, and does not use up annual leave.
Still yours
Keeping count of the paid hours under your collective agreement or the agreement with the workers’ legal representatives: Quantummycos does not cap the four days and records full or half days, not hours.
- Helps you comply
Respect the suspension of the contract for birth and childcare (nineteen weeks per parent), parental leave (up to eight weeks before the child turns eight) and breastfeeding leave
Arts. 48.4, 48 bis and 37.4 Workers’ StatuteWith QuantummycosAll plans
They have their own absence types, “Birth and childcare”, “Parental leave” and “Breastfeeding”, which are requested and approved with a record of who did it and when, and do not use up annual leave.
Still yours
Working out each person’s weeks and deadlines, receiving their notice (fifteen days for the flexible weeks of birth leave and for breastfeeding leave, ten for parental leave) and applying breastfeeding leave the way the person chooses: an hour off a day, half an hour less each day or accumulated into full days. Quantummycos records full or half days and does not control durations or notice.
- Helps you comply
Give twenty hours of paid leave a year for vocational training linked to the company’s business, which can build up over as many as five years, to staff with at least one year’s service
Art. 23.3 Workers’ StatuteWith QuantummycosAll plans
Training is requested and approved as an absence of the type “Exams or training”, which stays in the person’s history and does not use up annual leave.
Still yours
Keeping count of the twenty hours and how they build up, and agreeing with the person how they are taken if your collective agreement does not say: absences are full or half days and there is no training-hours counter. The right is met if the person can do that training within a training plan run by the company or agreed in a collective agreement.
- Still yours
Negotiate requests to adapt working hours for work-life balance and reply in writing within fifteen days
Art. 34.8 Workers’ StatuteWith QuantummycosAll plans
Whatever is agreed is applied on the person’s profile: their daily hours and their start and finish times, which Quantummycos then uses to work out their overtime and late arrivals and to remind them to clock in.
Still yours
Unless your collective agreement sets another procedure, opening the negotiation and replying in writing within fifteen days at most: accepting, proposing an alternative or refusing with objective reasons. Without a reasoned objection within that time, the request is deemed granted.
- Still yours
Grant reduced working hours to care for a child under twelve, a person with a disability, or a spouse, civil partner or relative who cannot look after themselves, and for a son or daughter with cancer or another serious illness
Art. 37.6 and 37.7 Workers’ StatuteWith QuantummycosAll plans
It is applied by changing the daily hours on their profile, which the clock-in timeline then uses to work out their overtime.
Still yours
Granting it in the cases set by law, from one eighth to half of the working day (at least half for a serious illness), with a proportional cut in pay. The person chooses the exact hours and gives fifteen days’ notice, or whatever your collective agreement sets.
- Still yours
Send the INSS, through the RED system and within three working days at most, the company’s data on each period of sick leave
Art. 7.2 RD 625/2014Doing it on time once the INSS reports the sick leave, through the RED system or your accountant: Quantummycos does not connect to the Social Security system. Since April 2023, employees no longer have to give the company a copy of their sick note.
If you do not comply
Breaching the rules on annual leave, paid leave and working time in articles 23 and 34 to 38 of the Statute is a serious infringement under article 7.5 of the Law on Infringements and Sanctions in the Social Order (LISOS): a fine of €751 to €7,500 (art. 40.1.b). Failing to send the INSS the data on a period of sick leave on time is a minor infringement (art. 21.4): €70 to €750 (art. 40.1.a).
Work calendar
Work calendar and public holidays: articles 34.6 and 37.2 of the Workers’ Statute
Royal Legislative Decree 2/2015, of 23 October, approving the consolidated text of the Workers’ Statute ActWith Quantummycos
On the Enterprise plan, the Work calendar fills itself in with each year’s national holidays and stores regional and local holidays and company closures; each person’s holidays do not use up their annual leave and are marked on their absence calendar, and on those days they get no reminder to clock in.
- Who it applies to
- Every company, from the first hire, with a calendar on display at each workplace. Public holidays are the national ones, those of the autonomous community and the two local ones of the municipality where each workplace is.
Article 34.6 of the Statute requires the company to draw up the work calendar every year and to display a copy in a visible place at each workplace. Article 37.2 sets the public holidays: paid, not to be made up and no more than fourteen a year, two of them local. Within that limit, each autonomous community can replace some national holidays with its own.
- Helps you comply
Draw up the work calendar every year and display a copy in a visible place at each workplace
Art. 34.6 Workers’ StatuteWith QuantummycosEnterprise plan
The Work calendar fills itself in with the national holidays for this year and next, and in it you mark regional holidays, local ones for the people you choose and company closures, with the whole year in view and, beside it, the list of days and who each one applies to.
Still yours
Consulting the workers’ legal representatives first, if there are any, checking which national holidays your autonomous community replaces or moves, completing the calendar with working hours and how working time is spread over the year, and displaying it at each workplace: Quantummycos does not publish it for you.
- Helps you comply
Respect public holidays, which are paid and not to be made up, with a maximum of fourteen a year, two of them local
Art. 37.2 Workers’ StatuteWith QuantummycosEnterprise plan
Each person gets their own holidays: the national ones for their country, the regional ones for their autonomous community and the local ones they are picked for. That day does not use up any absence days, is marked on the absence timeline and calendar and, if they clock in, they get a warning; they do not get the clock-in reminder either.
Still yours
Giving each workplace’s public holidays as paid days off, without asking for them to be made up, and paying or compensating work on a holiday as your collective agreement says: the warning does not stop anyone clocking in and Quantummycos does not calculate that compensation.
If you do not comply
Not displaying the work calendar in a visible place at the workplace is a minor infringement under article 6.1 of the Law on Infringements and Sanctions in the Social Order (LISOS): a fine of €70 to €750 (art. 40.1.a). Breaching the rules on public holidays and rest is a serious infringement (art. 7.5): €751 to €7,500 (art. 40.1.b).
Payslips
Payslips and pay: article 29 of the Workers’ Statute and the official model
Order of 27 December 1994 approving the model individual payslipWith Quantummycos
On the Professional and Enterprise plans, payslips go into each person’s “Payslips” folder, which only they and the company’s administrators can see and which they open on the web and in the app; with “Upload latest payslip”, AI reads the most recent one and suggests the pay figures for their profile.
- Who it applies to
- Every company, from the first hire. The official model can be replaced by another one set in a collective agreement or, failing that, agreed with the workers’ legal representatives.
Article 29 of the Statute requires wages to be paid on time, for periods of no more than a month, and documented with an individual payslip given to each person. The Order of 27 December 1994 sets the official model for that payslip, which covers calendar months and is signed on delivery or, when pay goes by bank transfer, handed over unsigned with the bank’s receipt taking the place of the signature. Payslips are kept for at least five years, together with the Social Security contribution documents.
- Helps you comply
Document pay with an individual payslip for each calendar month, using the official or the agreed model
Art. 1 Order of 27/12/1994 and art. 29.1 Workers’ StatuteWith QuantummycosProfessional and Enterprise plans
To calculate the payslip, Analytics and reporting gives each person’s hours worked and overtime by month and their absences in the period by type, in Excel or PDF.
Still yours
Calculating and issuing the payslip with your accountant or payroll software, with every item in the model: Quantummycos does not calculate it.
- Helps you comply
Give each person a copy of their payslip: they sign it on receipt or, when paid by bank transfer, the bank’s receipt replaces their signature
Art. 2 Order of 27/12/1994 and art. 29.1 Workers’ StatuteWith QuantummycosProfessional and Enterprise plans
Payslips go into each person’s “Payslips” folder, which only they and the company’s administrators can see, with a record of who uploaded each one and when. They open them on the web and in the app, all in one place, and download them from the web. With “Upload latest payslip”, AI reads it and the copy is filed in that folder automatically, with the month in its name.
Still yours
Uploading each month’s payslip to their “Payslips” folder and keeping the receipt for each transfer, which stands in for the signature (if you pay in cash or by cheque, the person signs the payslip). Quantummycos does not record whether the person opened the payslip, and an archived person can no longer sign in: upload their last payslip before archiving them or get it to them another way.
- Helps you comply
File and keep payslips, together with the contribution documents, for at least five years
Art. 3 Order of 27/12/1994With QuantummycosProfessional and Enterprise plans
Payslips in each person’s folder have no deletion date, and archiving someone who leaves keeps them along with the rest of their history.
Still yours
Not deleting them or the person who leaves (archive them instead), also keeping the payment receipts and contribution documents and, if you leave Quantummycos, downloading them first: under the data processing agreement, the data is kept blocked for four years, not five.
- Still yours
Pay wages on time, on the agreed date and at the agreed place, for periods of no more than a month
Art. 29.1 and 29.3 Workers’ StatutePaying on the agreed date. If payment is late, interest of 10% of the amount owed is also due.
If you do not comply
Not handing over the payslip on time or not using the official or agreed model is a minor infringement under article 6.2 of the Law on Infringements and Sanctions in the Social Order (LISOS): a fine of €70 to €750 (art. 40.1.a). Not showing the amounts actually paid is serious (art. 7.3): €751 to €7,500. Non-payment and repeated late payment of wages are very serious (art. 8.1): €7,501 to €225,018. And not keeping pay receipts and contribution documents for four years is minor (art. 21.1): €70 to €750.
Written contract terms
Written information on the employment contract: Royal Decree 723/2026
Royal Decree 723/2026, of 9 September, transposing Directive (EU) 2019/1152 of the European Parliament and of the Council of 20 June 2019 on transparent and predictable working conditions in the European UnionWith Quantummycos
On the Professional and Enterprise plans, the information document goes in each person’s folder, where they open it on the web and in the app, and the upload date is kept; with Document compliance (Enterprise), so is the date on which each person confirmed reading what is common to all staff.
- Who it applies to
- Every company, for employment relationships lasting more than four weeks. For contracts already in force on 5 October 2026, the information is given to whoever asks for it, and later changes to everyone.
- Where it stands
- In force since 5 October 2026. It implements article 8.5 of the Workers’ Statute, transposes Directive (EU) 2019/1152 and replaces Royal Decree 1659/1998. It asks the Ministry of Labour, through the State Public Employment Service (SEPE), for a model information document, but the obligation does not depend on it.
In any employment relationship lasting more than four weeks, the company must give written information, before it starts, on the essential terms of the contract: among others, base salary and each complement separately, working hours and how they are distributed, overtime, annual leave, the probation period, the applicable collective agreement, the equality plan and the harassment protocol. If they are already in the written contract, the obligation is met. Each change is given in writing by the day it takes effect at the latest, and the company keeps proof of delivery.
- Quantummycos does it
If it is given electronically, make sure the person can access, store and print it
Art. 6.2 RD 723/2026With QuantummycosProfessional and Enterprise plans
Each person opens their file folder on the web and in the app whenever they like, and downloads any document from the web to store or print it.
- Helps you comply
Give written information on the essential terms of the contract: the parties, start date, workplace, duties and job group, base salary and complements, working hours and their distribution, overtime, annual leave, probation period, collective agreement, equality plan and harassment protocol, among others
Art. 3.1 and 3.2 RD 723/2026With QuantummycosAll plans
Each person’s profile holds several of those details: contract type, start date, job title, working hours and schedule, their annual leave days for each year and, visible only to the company’s administrators, their annual base salary and, separately, the total of their complements.
Still yours
Drafting the information with every item in article 3, each salary complement listed separately, or checking that they are already in the written contract the person holds: Quantummycos does not generate that document.
- Helps you comply
Provide it before the employment relationship starts and give each change in writing by the day it takes effect at the latest
Art. 7.1 and 7.3 RD 723/2026With QuantummycosProfessional and Enterprise plans
The document goes in the person’s file folder, which records who uploaded it and when, and they open it on the web and in the app.
Still yours
Uploading it before the first day and, with each change, by the day it takes effect at the latest. The person sees it as soon as they accept their invitation, so it is worth inviting them before they start. For anyone already working for you on 5 October 2026 who asks for it, providing it within thirty working days if they do not already have it.
- Helps you comply
Keep proof that it was sent or received
Art. 6.2 RD 723/2026With QuantummycosEnterprise plan
With Document compliance, whatever is the same for all staff, such as the collective agreement, the equality plan or the harassment protocol, can be set up as a “Read and confirm” requirement, which records the date each person confirmed reading it; and the signed contract as a document that is handed in and approved, with its date.
Still yours
Choosing how you prove delivery of what is specific to each person, such as their pay or their schedule: a file in their folder records who uploaded it and when, but not whether they opened it, and “Read and confirm” shows the same document to the whole group.
- Still yours
Disclose whether the company uses algorithmic or automated decision-making systems and, where they are used to decide or change working conditions, their guidelines, criteria and rules
Art. 3.2.k RD 723/2026If the company uses algorithmic or automated systems to make decisions, telling staff that they exist and, where those systems are used to decide or change working conditions such as working hours, tasks, pay, promotion, place of work or termination of the contract, explaining their guidelines, criteria and rules.
If you do not comply
Failing to give written information on the essential terms of the contract in the way and within the deadlines set by regulation is a minor infringement under article 6.4 of the Law on Infringements and Sanctions in the Social Order (LISOS): a fine of €70 to €750 (art. 40.1.a).
Starters and leavers
Starters, leavers, contracts and final settlement: Royal Decree 84/1996 and articles 8 and 49 of the Workers’ Statute
Royal Decree 84/1996, of 26 January, approving the General Regulation on the registration of companies and the enrolment, registration, deregistration and changes of details of workers in the Social Security systemWith Quantummycos
With Onboarding and offboarding (Enterprise plan), Social Security registration and deregistration, notice that a contract is ending and working out and signing the final settlement are on the standard task lists for every starter and leaver, with who marked each step as done and when.
- Who it applies to
- Every company that hires employees, from the first hire. The basic copy of contracts that must be in writing goes to the workers’ legal representatives where there are any and, if not, is still sent to the employment office.
- Where it stands
- In force. Since 1 August 2026, deregistration must be filed within six calendar days of the person leaving, not three (Royal Decree 643/2026). That decree also gives companies six months from that date to report to the Social Security General Treasury the occupation code of each person registered, if they had not already done so.
Royal Decree 84/1996 requires the company to register each person with the Social Security system before they start work, and never more than sixty days in advance, and to report their departure within six calendar days of leaving. The Workers’ Statute adds reporting each contract and its extensions to the public employment service within ten days, giving the workers’ representatives a basic copy of contracts that must be in writing (art. 8) and, when a contract ends, sending a proposed final settlement with the notice (art. 49.2).
- Helps you comply
Send a proposed final settlement with the notice that the contract is ending, and let a workers’ representative attend the signing if the person asks
Art. 49.2 Workers’ StatuteWith QuantummycosEnterprise plan
The standard “Leaver” process includes working out the final settlement and untaken leave and signing it off, and the “End of fixed-term contract” process includes giving notice and the signing, with who marked each step as done and when. The person’s profile shows how many days of annual leave they have left this year.
Still yours
Calculating the amount, handing over the proposal with the notice and, at signing, stating on the receipt whether a representative was present or the person did not ask for one: Quantummycos does not generate the document.
- Still yours

- Still yours
Report the content of each contract and its extensions to the public employment service within ten days
Art. 8.3 Workers’ StatuteReporting it on time, through Contrat@ or your accountant: Quantummycos does not report contracts.
- Still yours
Within ten days, give the workers’ legal representatives a basic copy of each contract that must be in writing, and then send it to the employment office
Art. 8.4 Workers’ StatutePreparing it without the DNI or NIE, home address, marital status or other details that affect privacy, giving it to the representatives, who sign it as an acknowledgement, and sending it to the employment office, also where there are no representatives.
- Still yours
Report the person’s departure to the Social Security system within six calendar days of leaving
Art. 32.3.2 RD 84/1996With QuantummycosEnterprise plan
Both standard offboarding processes include the task “Deregister from social security”, with a record of who marked it as done and when.
Still yours
Filing the deregistration through the RED system or your accountant within the deadline: Quantummycos does not report it.
If you do not comply
Failing to register a new starter is a serious infringement under article 22.2 of the Law on Infringements and Sanctions in the Social Order (LISOS), counted once per person affected: a fine of €3,750 to €12,000 (art. 40.1.e). Not reporting a leaver on time is minor (art. 21.3), as is failing to report new hires to the employment office (art. 14.1): €70 to €750 (art. 40.1.a). Breaching the rules for processing the final settlement receipt is serious (art. 7.4): €751 to €7,500 (art. 40.1.b).
Remote work
Teleworking: Law 10/2021 on remote work
Law 10/2021, of 9 July, on remote workWith Quantummycos
With Time tracking and clock-ins, remote staff record the start and end of their working day from home just as in the office, and with Document compliance (Enterprise) you keep their signed remote working agreement.
- Who it applies to
- Companies with employees who work remotely on a regular basis: at least 30% of their working time over a three-month period, or the equivalent percentage for the length of the contract.
When someone works remotely for at least 30% of their working time over a three-month period, a written agreement with minimum content is required, the company provides the equipment and covers the costs, and the working-time record must reflect the time actually worked. The company also assesses the risks of the remote workstation, monitors work with respect for privacy and guarantees the right to disconnect outside working hours.
- Quantummycos does it
Make sure the working-time record faithfully reflects remote working time, including the start and end of each working day
Art. 14 Law 10/2021With QuantummycosAll plans
Remote staff clock in, take breaks and clock out from the web or the app, just as in the office. The time is set by the server, not the device, and every correction stays in the history with its reason, who made it, when and what was there before.
- Helps you comply
Sign a written remote work agreement before remote work starts and give a copy to the workers’ legal representatives within ten days
Arts. 5 and 6 Law 10/2021With QuantummycosEnterprise plan
The Document compliance catalogue includes a “Remote working agreement” type for uploading the signed agreement: it waits for approval and records who approved it and when. The “Remote starter” process in Onboarding and offboarding includes the task “Sign the contract and the remote working agreement”, recording who marked it done and when.
Still yours
Draft the agreement and sign it before remote work begins. Within the following ten days, give a copy to the workers’ legal representatives, without any data affecting privacy, and then send it to the public employment office. If there are no representatives, a basic copy still goes to the employment office.
- Helps you comply
Provide and maintain the equipment, devices and tools needed for remote work

Provide the equipment listed in the agreement’s inventory, accessible if the employee has a disability, maintain it and deal with technical problems.
- Helps you comply
Assess the risks of the remote workstation, paying attention to psychosocial, ergonomic and organisational factors, and plan the measures
Art. 16 Law 10/2021With QuantummycosEnterprise plan
The “Remote starter” process in Onboarding and offboarding includes the task “Risk assessment of the home workstation”, recording who marked it done and when.
Still yours
Carry out the assessment, limited to the area where the person works and not the whole home, and plan the measures. Visiting the home requires the employee’s permission and a written report justifying the visit; without permission, the assessment is based on the information they provide.
- Helps you comply
Respect privacy and data protection when monitoring remote work, without requiring employees to install apps on, or use, their own devices
Art. 17 Law 10/2021 and art. 90 LOPDGDDWith QuantummycosProfessional and Enterprise plans
Location is only stored at the moment of clocking in, never during the day or in the background. It is switched on by default on the Professional and Enterprise plans, and the company can switch it off or make it mandatory in Settings.
Still yours
Decide whether storing the position of someone clocking in from home is proportionate, and tell them, and their representatives if there are any, expressly beforehand (art. 90 LOPDGDD). And do not require them to install the app on their own phone: they can clock in from the web on the company’s equipment.
- Still yours
Include the minimum content in the agreement: equipment and costs, working hours, share of remote work, workplace and remote location, reversibility, monitoring methods, technical problems, data protection, information security and duration
Art. 7 Law 10/2021Draft the agreement with all the minimum content required by law and anything your collective agreement adds.
- Still yours
Pay or compensate the costs of remote work
Art. 12 Law 10/2021Cover or compensate the costs of equipment, tools and resources as set out in the agreement or your collective agreement: remote staff cannot be made to bear them.
- Still yours
Guarantee remote staff’s right to disconnect outside their working hours
Art. 18 Law 10/2021Limit the use of work tools during rest periods, respect maximum working hours and apply the internal right-to-disconnect policy required by art. 88 LOPDGDD, drawn up after hearing the workers’ legal representatives.
If you do not comply
Failing to put the remote work agreement in writing, or doing so without the legal requirements, is a serious infringement (art. 7.1 LISOS): €751 to €7,500 (art. 40.1.b LISOS). A working-time record that does not capture remote staff’s hours is also a serious infringement (art. 7.5), with the same fine.
Workers’ representatives
Informing and consulting workers’ representatives: article 64 of the Workers’ Statute
Royal Legislative Decree 2/2015, of 23 October, approving the consolidated text of the Workers’ Statute ActWith Quantummycos
With Analytics and reporting (Professional) you download each quarter’s absences and the pay register broken down by sex, in PDF or Excel, to hand to the workers’ representatives.
- Who it applies to
- Companies or workplaces with workers’ legal representatives: staff delegates from 11 employees (or from 6, if the staff decide so by majority) and a works council from 50. Staff delegates have the same powers as a works council.
Where there are staff delegates or a works council, the company must inform them, among other things, about absenteeism and accidents every quarter and about equality between women and men at least once a year. It must also explain the rules of the algorithms that affect working conditions or access to and retention of employment, and ask for their report before introducing a monitoring system, such as clocking in.
- Helps you comply
Inform the workers’ representatives every quarter about absenteeism and its causes, work accidents, occupational diseases and accident rates
Art. 64.2.d Workers’ StatuteWith QuantummycosProfessional and Enterprise plans
The Leave and absence report gives, for the period you choose (a quarter, for example), each absence with its type, dates and days, plus a summary per person with their sick days. It can be narrowed down to one type, such as “Work accident”, and downloaded as PDF or Excel.
Still yours
Prepare each quarter’s information and hand it to the representatives, with the causes of absenteeism, the absence rate, accident rates and the prevention measures in use: the app does not calculate those rates or send anything.
- Helps you comply
Inform the workers’ representatives at least once a year about equality between women and men, with the pay register and the proportion of each sex at each professional level
Art. 64.3 Workers’ StatuteWith QuantummycosProfessional and Enterprise plans
The Pay report gives, for each job title, how many women and men there are, their average basic pay and complements, and the mean and median gap. It can be downloaded as PDF or Excel.
Still yours
Hand it to the representatives at least once a year, with the equality measures you have taken and, if you have an equality plan, how it is being applied. The report groups people by the job title on their profile: if your professional levels are different, you prepare the proportion by level yourself. And it withholds the figures for jobs with fewer than three women or three men, which the representatives are entitled to see: you fill those in yourself.
- Still yours
Inform the workers’ representatives of the parameters, rules and instructions behind any algorithms or AI systems that affect decisions on working conditions or on access to and retention of employment, including profiling
Art. 64.4.d Workers’ StatuteCheck which tools influence decisions about staff or candidates, such as automatic CV screening or software that allocates tasks, including any that build profiles, and inform the representatives of the parameters, rules and instructions they are based on.
- Still yours
Ask the workers’ representatives for their report before introducing or changing a system for monitoring work, such as clocking in or location at clock-in
Art. 64.5.f and 64.6 Workers’ Statute (and 62.2 for staff delegates)Request the report, with the necessary information, before putting the system in place: the representatives have at most fifteen days from receiving it to issue their report. Location at clock-in is switched on by default on the Professional and Enterprise plans: switch it off in Settings until the consultation is done.
If you do not comply
Breaching the representatives’ rights to information, hearing and consultation is a serious infringement (art. 7.7 LISOS): €751 to €7,500 (art. 40.1.b LISOS).
Equal treatment
Equal treatment and non-discrimination: Law 15/2022
Comprehensive Law 15/2022, of 12 July, for equal treatment and non-discriminationWith Quantummycos
Quantummycos gives staff a way to report discrimination, the Whistleblowing channel, and its pay register compares what women and men are paid; making decisions without discriminating is up to your company.
- Who it applies to
- Every company, with no threshold, across the whole employment cycle: recruitment, working conditions, pay and dismissal.
Nobody may be discriminated against on grounds of sex, racial or ethnic origin, age, disability, sexual orientation or identity, gender expression, illness or health condition, religion, language, socio-economic status or any other personal or social circumstance. At work, the law covers recruitment, training, promotion, pay, working hours and dismissal, and bans asking job applicants about their health.
- Still yours
Do not discriminate in recruitment, training, promotion, pay, working hours or dismissal
Art. 9.1With QuantummycosEnterprise plan
In the Whistleblowing channel, anyone on the staff can report discrimination, under their name or anonymously, and through the public entry so can job applicants. Whoever manages the channel handles it and replies within the channel.
Still yours
Make hiring, promotion, pay and dismissal decisions on objective criteria and act on every report.
- Still yours
Do not use recruitment criteria or working conditions that, while appearing neutral, discriminate indirectly
Art. 9.2With QuantummycosProfessional and Enterprise plans
The pay register compares what women and men are paid, across the workforce and by job. It does not compare on other grounds, such as age or origin.
Still yours
Review recruitment, promotion and pay criteria that, while appearing neutral, disadvantage a group, and correct those without an objective justification.
- Still yours
Do not ask job applicants about their health
Art. 9.5Review application forms, questionnaires and interviews so that none of them ask about health.
If you do not comply
Discrimination in pay, working hours, training, promotion and other working conditions is a very serious infringement (art. 8.12 LISOS, €7,501 to €225,018), with loss of employment aid and rebates (art. 46 bis). So is asking for personal data in a recruitment process or setting conditions that discriminate in access to employment (art. 16.1.c).
Disability
2% disability quota and workplace adjustments: General Disability Law
Royal Legislative Decree 1/2013, of 29 November, approving the Consolidated Text of the General Law on the Rights of Persons with Disabilities and their Social Inclusion- Who it applies to
- The reserved quota: public and private companies with 50 or more workers, counted across the whole company. Workplace adjustments: every company.
- Where it stands
- Since 23 October 2026, under Law 4/2026, workplace adjustments also extend to the spouse or registered partner and to relatives up to the second degree by blood who care for a person with a disability. The 2% quota is unchanged.
Companies with 50 or more workers must have at least 2% of their workforce made up of people with disabilities, or apply alternative measures if they are exempted by a sector-wide collective agreement or by a decision notified to the labour authority. All of them, whatever their size, must adapt the job and accessibility for people with disabilities and, since 23 October 2026, also for their spouse or partner and the relatives who care for them, unless that is an excessive burden.
- Still yours
With 50 or more workers, have at least 2% of the workforce made up of people with disabilities or apply the alternative measures
Art. 42.1Calculate the quota on the total workforce, across all workplaces and contracts, and meet it, or take up the exemption through a sector-wide collective agreement or a decision notified to the labour authority and apply the alternative measures. Quantummycos does not store disability data or calculate the quota.
- Still yours
Adapt the job and accessibility for people with disabilities and, since 23 October 2026, for their spouse or registered partner and relatives up to the second degree by blood who care for them, unless it is an excessive burden
Art. 40.2Assess each case and take reasonable measures. Whether a burden is excessive depends on public aid, the cost, and the size and turnover of the company.
If you do not comply
Failing to meet the reserved quota or its alternative measures is a serious infringement (art. 15.3 LISOS, €751 to €7,500). Refusing a reasonable adjustment can amount to disability discrimination, a very serious infringement (art. 8.12, €7,501 to €225,018).
Special working hours
Shift work and special working hours: Royal Decree 1561/1995
Royal Decree 1561/1995, of 21 September, on special working hoursWith Quantummycos
On every plan, the clock-in timeline flags every rest of less than twelve hours between working days, including at a shift change, so you can check whether your sector allows it and make up for it.
- Who it applies to
- Companies in the sectors and jobs it lists (residential building staff, security guards, farming, retail and hospitality, transport, work at sea, shift work, mining and others), only for what it regulates in each and not in special employment relationships, which follow their own rules. Its general rules, working-time extensions and night-work rules apply only to over-18s.
It implements articles 34.7, 36.1 and 37.1 of the Workers’ Statute: in certain sectors and jobs it allows longer working days or shorter daily and weekly rest, and in others, such as mining or cold stores, it limits working time. Any reduction in rest must be made up with alternative rest at least as long, which as a rule cannot be paid in cash.
- Helps you comply
In shift work, if a shift change leaves less than twelve hours’ rest between working days, do not go below seven and make up the difference in the following days
Art. 19 Royal Decree 1561/1995With QuantummycosAll plans
The clock-in timeline flags any rest of less than twelve hours between two working days, including at a shift change, showing how many hours there were.
Still yours
Checking that each short rest is due to a shift change and does not fall below seven hours, and giving the shortfall up to twelve hours in the days immediately after: the warning does not know about this exception or keep track of the compensation.
- Still yours
Make up for any reduction in daily or weekly rest with alternative rest at least as long, which except in specific cases cannot be paid in cash
Art. 2 Royal Decree 1561/1995Planning and giving the compensatory rest within the reference period for each case. It can only be paid in cash in specific cases, such as the contract ending for reasons other than its term, and Quantummycos does not keep count of the rest owed.
If you do not comply
Outside what the royal decree allows, breaching rest periods is a serious infringement under article 7.5 of the Law on Infringements and Sanctions in the Social Order (LISOS): a fine of €751 to €7,500 (art. 40.1.b).
Pay transparency
Pay transparency: Directive (EU) 2023/970
Directive (EU) 2023/970 of the European Parliament and of the Council of 10 May 2023 to strengthen the application of the principle of equal pay for equal work or work of equal value between men and women through pay transparency and enforcement mechanismsWith Quantummycos
Quantummycos’s pay register already calculates the Directive’s pay gap indicators, flags jobs with a gap of 5% or more and prepares the written answer for anyone who asks about their pay; it compares by job, not by work of equal value.
- Who it applies to
- All employers, once transposed. The gap report, under the Directive, from 100 workers, first due in 2027 from 150 and in 2031 from 100 to 149; the Spanish draft requires it from 50, but only from companies with a pay audit.
- Where it stands
- The Directive is in force, but Spain has not transposed it and the deadline passed on 7 June 2026. There is only a draft royal decree that partly incorporates it, not yet approved, so its obligations are not yet in any Spanish rule binding on companies.
It strengthens equal pay for women and men through transparency: the starting pay or pay range before hiring, each person’s right to know in writing the average pay, by sex, of those doing the same work or work of equal value, a pay gap report depending on headcount and a joint assessment when a category’s gap reaches 5% without justification. Until it is transposed, Spain applies the pay register of Royal Decree 902/2020.
- Helps you comply
Once transposed: reply in writing, within two months at most, to anyone who asks for their pay and the average pay, by sex, of those doing the same work or work of equal value
Art. 7With QuantummycosProfessional and Enterprise plans
Pick a person and the pay register prepares their written answer: their own pay and the mean and median for their job for women and men, with the deadline to reply. If their job has fewer than three women or three men, it leaves those figures out so that nobody’s pay is revealed.
Still yours
Reply on time, remind staff of this right every year and group together work of equal value, because the register compares people in the same job. Today, under Royal Decree 902/2020, someone who asks without workers’ legal representatives is only owed the percentage differences.
- Helps you comply
Once transposed: report the gender pay gap as often as the Spanish rule requires for your headcount
Art. 9With QuantummycosProfessional and Enterprise plans
The pay register already calculates those figures: the gap in mean and median terms, including for complements, the share of women and men who receive them, the quartiles and the gap per job. It also says how often the report would be due for your headcount under the Directive.
Still yours
Confirm the figures after consulting the workers’ legal representatives and send them to the body the Spanish rule designates, whose draft changes thresholds and dates. Quantummycos sends nothing to any authority.
- Helps you comply
Once transposed: carry out a joint pay assessment with the workers’ representatives if the pay gap report shows a gap of at least 5% in a category that is neither justified nor corrected within six months
Art. 10With QuantummycosProfessional and Enterprise plans
The pay register flags jobs with an average gap of 5% or more and warns that, if it is neither justified nor corrected, a joint pay assessment is required.
Still yours
Justify the gap on objective, gender-neutral criteria or correct it within six months and, if not, carry out the assessment with the workers’ representatives. The Spanish draft moves this analysis into the pay audit of the equality plan.
- Still yours
Once transposed: give job applicants the starting pay or its range before hiring, and do not ask them about their previous pay
Art. 5Prepare your job ads and interviews. The Spanish transposition draft does not yet include this obligation.
- Still yours
Once transposed: make available to staff the criteria used to set pay, pay levels and pay progression
Art. 6Set those criteria, objective and gender-neutral, and keep them available to staff. Under the Spanish draft, if they are in the collective agreement it is enough to refer to its articles, and progression only has to be explained from 50 workers.
Digital time recording
Digital time recording: the draft royal decree
Draft Royal Decree implementing the consolidated text of the Workers’ Statute Act on working-time recordsWith Quantummycos
Clocking in with Quantummycos is already digital and personal, with the server’s time, no deletion and a trace of every correction, as the draft proposes.
- Who it applies to
- If approved, every company, including special employment relationships and the special working hours of Royal Decree 1561/1995. For staff supplied by a temporary work agency, the user company.
- Where it stands
- Still in the approval process. As of 27 October 2026 it has not been approved or published in the BOE, so it is not binding today: the obligation in force is article 34.9 of the Workers’ Statute. The articles cited are those of the October 2025 public consultation text, which may change before approval; under that text, it would come into force twenty days after publication in the BOE.
It would implement articles 12.4.c, 34.9 and 35.5 of the Workers’ Statute: the record would be digital, each person would make their own entries at the time, no change could be made without the authorisation of both the company and the person, and staff, their legal representatives and the Labour Inspectorate would have immediate access. The technical requirements would be set later in implementing rules, which do not exist yet; a system that did not follow them would be valid if it meets the same principles and is justified by a report from a qualified technician.
- Quantummycos does it
If approved: a daily digital record, with entries made by the person themselves at the time and an indelible trace of every change and who made it
Arts. 2 and 4.a of the draftWith QuantummycosAll plans
It already works this way: each person clocks in with their own account on the web or in the app at the time, the server sets the time and a past time cannot be clocked. A clock-in is never deleted, and every correction keeps the before and after, who made it, when and why.
- Quantummycos does it
If approved: minimum content including who the person is, the start and end of each working day and each break to the minute, daily and monthly totals and who made each change
Art. 3 of the draftWith QuantummycosAll plans
It already has it: who clocks in, the start and end time of the day and of each break, the hours worked each day and the monthly total, and who made each correction or whether the person asked for it.
- Quantummycos does it
If approved: each person can check their entries and any changes at any time
Art. 6.1 of the draftWith QuantummycosAll plans
It already works this way: each person sees all their clock-ins and breaks straight away on the web, and the latest ones in the app, with a mark on those the company corrected and, on the web, the history of each correction.
- Helps you comply
If approved: no entry may change without the authorisation of both the company and the employee
Arts. 2.2.b and 4.b of the draftWith QuantummycosAll plans
Anyone who cannot correct their own clock-in asks for the change with a reason, and the company approves or rejects it. Both the request and the decision are kept.
Still yours
Under the October 2025 text, also obtaining the person’s agreement when the company corrects on its own initiative and, if they disagree, informing the legal representatives and recording the disagreement: Quantummycos does not ask for it.
- Helps you comply
If approved: each person can get a copy of their entries instantly and receives the period summary with their payslip
Art. 6.1 of the draftWith QuantummycosProfessional and Enterprise plans
The working-time record report comes out as a PDF or Excel file per person and month, ready to hand over with the payslip.
Still yours
Under the October 2025 text, the person would have to be able to get the copy themselves. Today it is downloaded by someone with access to Analytics and reporting, which the Employee role does not have by default, and the company hands over the summary with the payslip.
- Still yours
If approved: also mark whether each day is on site or remote, tell apart ordinary, overtime and supplementary hours, and record waiting and on-call time
Art. 3 of the draftUnder the October 2025 text, Quantummycos would be missing these details, among others: it treats time beyond the contracted hours as overtime, but does not separate supplementary hours or say whether overtime is paid or compensated, and does not record whether the day was on site or remote, or waiting time.
- Still yours
If approved: immediate access to the record for the workers’ legal representatives, without data such as ID numbers, and for the Labour Inspectorate, remotely as well
Arts. 6.2 and 6.3 of the draftUnder the October 2025 text, the system itself would have to give them this access. Quantummycos does not offer it today: the record is handed to them as a download from the report.
- Still yours
If approved: a protocol for organising and documenting the record, after consulting the legal representatives, and staff training during working time
Art. 7 of the draftWriting it (how entries are made and corrected, what data they hold and how the record is reviewed with the workers’ legal representatives) and training those who clock in, during working hours and at no cost to them.
Frequently asked questions
Most apply from the first hire: the working-time record (article 34.9 of the Workers’ Statute), the pay register (Royal Decree 902/2020), staff data protection (GDPR and Organic Law 3/2018), occupational risk prevention (Law 31/1995), a protocol against sexual and gender-based harassment (Organic Law 10/2022), annual leave, paid leave and the work calendar (articles 34, 37 and 38 of the Workers’ Statute), payslips (article 29 of the Workers’ Statute), written information on the employment contract (Royal Decree 723/2026) and Social Security registration and deregistration (Royal Decree 84/1996). With 50 or more workers, add the whistleblowing channel (Law 2/2023), the equality plan (Organic Law 3/2007) and the 2% quota for people with disabilities; with more than 50, the LGTBI measures and protocol (Law 4/2023). If anyone works remotely for at least 30% of their working time, Law 10/2021 also applies. Your collective agreement may extend or specify these obligations.
From 50 workers, under Law 2/2023 on whistleblower protection. Companies subject to EU rules on financial services, anti-money laundering, transport safety or environmental protection need one whatever their size, as do political parties, trade unions and employers’ organisations that receive or manage public funds. Below 50 it is voluntary, but a channel set up voluntarily must meet all the requirements of the Law. Failing to have the internal reporting system when it is mandatory is a very serious infringement if intentional (art. 63.1): for a company, a fine of €600,001 to €1,000,000 (art. 65.1.b).
From 50 workers (article 45.2 of Organic Law 3/2007), counting the whole workforce across all workplaces and contracts; each part-time worker counts as one (article 3 of Royal Decree 901/2020). Below that, it is only mandatory if the collective agreement requires it or the labour authority imposes it in place of ancillary penalties. The negotiating committee is set up within three months of reaching 50 people, and the plan, negotiated after a diagnosis, is entered in a public register and lasts four years at most (Royal Decree 901/2020). With more than 50 people, the LGTBI measures and protocol of Law 4/2023 are added. Quantummycos’s pay register (Professional) gives the diagnosis the gap by sex and job; negotiating, registering and monitoring the plan is up to the company.
Yes. Article 28.2 of the Workers’ Statute and Royal Decree 902/2020 require every company, whatever its size, to keep a pay register (registro retributivo, also called registro salarial): the mean and median pay of women and men in each group, category or job, broken down by base salary, each complement and each non-salary payment. The workers’ legal representatives, if there are any, must be consulted at least ten days before it is drawn up. With 50 or more people, a gap of 25% or more between the sexes must be justified in the register itself. Quantummycos (Professional plan) produces it from the pay on each employee profile, which AI fills in by reading the payslip, as a PDF and in Excel; it has to be completed with what it does not break down, such as the median of each component or non-salary payments. Directive (EU) 2023/970 on pay transparency has not yet been transposed in Spain.
No. As of 27 October 2026, the royal decree on digital time recording has not been approved or published in the BOE, so it is not binding. What applies today is the daily working-time record of article 34.9 of the Workers’ Statute, in force since 12 May 2019. Under the October 2025 public consultation text, which may change, the record would be digital, each person would make their own entries at the time, no change could be made without the authorisation of both the company and the person, and the legal representatives and the Labour Inspectorate would have immediate access, including remotely. Clocking in with Quantummycos is already digital and personal, with the server’s time, no deletion and the history of every correction; it does not yet have that direct access for the representatives and the inspectorate.
Yes, if it is proportionate and staff are told beforehand. Article 90 of Organic Law 3/2018 (LOPDGDD) requires the company to inform staff and their representatives expressly, clearly and unambiguously before using geolocation, and article 64.5.f of the Workers’ Statute requires it to ask the legal representatives for a report before introducing a monitoring system like this. Quantummycos stores a single point, at the moment of clocking in: never when clocking out, during breaks or in the background. Clock-in geolocation is switched on by default on the Professional and Enterprise plans, so it is best to switch it off in Settings until staff have been informed and consulted.
Not on its own. Software can be the system the law requires: Quantummycos is the working-time record of article 34.9 of the Workers’ Statute, the pay register of Royal Decree 902/2020 and the internal channel of Law 2/2023. But many obligations are acts of the company that no software can perform for it: negotiating the equality plan, appointing the System Manager of the whistleblowing channel, assessing the risks of each job, registering and deregistering staff with Social Security or paying wages. That is why this page splits each obligation into three levels: what Quantummycos does, where it helps you and what is still yours. It is general information on the rules as of 27 October 2026 and does not replace professional advice or what your collective agreement says.
It records what article 34.9 of the Workers’ Statute requires, although the inspectorate assesses each case and nobody can guarantee the outcome of an inspection. On every plan, each person clocks in, takes breaks and clocks out on the web or in the app with the server’s time; no clock-in can be deleted, every correction keeps the before and after, who, when and why, and clock-ins have no deletion date. With Analytics and reporting (Professional), the record comes out as a PDF per person and month, with an annex of corrections, or in Excel. It is up to the company to organise the record by collective agreement, company agreement or after consulting the legal representatives, to make sure all staff clock in and to hand the record over when asked, because the inspectorate has no access of its own.
The internal channel, on the Enterprise plan. It takes written reports from the web, the app and a public entry with a link and QR code for people outside the staff; reports are anonymous by default, storing no name, IP address or device data, and are followed with a code. It lets those who manage the channel talk to the person reporting, shows the deadlines for acknowledgement (seven days) and response (three months), links to the external channel of the Independent Whistleblower Protection Authority and keeps the register of reports required by article 26, which only those managers can see. Still up to the company: consulting the legal representatives, appointing the System Manager and notifying the appointment within ten working days, approving the policy and the procedure, publishing information on the channel on its website, checking the channel and answering on time, holding the in-person meeting if asked, referring possible crimes to the Public Prosecutor, deleting data within the legal deadlines and not retaliating.
It manages payslips without calculating them. On the Professional and Enterprise plans, payslips go into each person’s “Payslips” folder, which only they and the company’s administrators can see and which they open on the web and in the app; with “Upload latest payslip”, AI reads it and suggests their pay figures, which feed the pay register, and Analytics and reporting gives your accountant each month’s hours, overtime and absences. Calculating the payslip stays with your accountant or payroll software, and Social Security registration, before the first day, and deregistration, within six calendar days of leaving (Royal Decree 84/1996), are filed through the RED system or by your accountant: Quantummycos does not connect to the Social Security system. With Onboarding and offboarding (Enterprise), those tasks are on the list for every starter and leaver, with who marked them as done and when.
